ผู้ต้องหา: ชายชาวเชียงราย 1
ภูมิหลังผู้ต้องหา: เป็นหนึ่งในสมาชิกกลุ่มแม่ลาวรักประชาธิปไตย กลุ่มกิจกรรมในจังหวัดเชียงราย โดยเคยทำกิจกรรมแสดงออกทางการเมือง เช่น การจุดเทียนเขียนสันติภาพ เมื่อวันที่ 10 ม.ค. 2557 ที่เวทีห้าแยกเม็งราย จ.เชียงราย, การออกแถลงการณ์ร่วมกับกลุ่มแม่ลาวรักประชาธิปไตยต่อต้านการชุมนุมของนายสุเทพ เทือกสุบรรณ และกลุ่ม กปปส. เป็นต้น
การกระทำที่ถูกกล่าวหา: วันที่ 25 พฤษภาคม 2557 เวลาประมาณ 18.00 น. ช.1 กับภรรยาผู้เป็นแกนนำกลุ่มแม่ลาวรักประชาธิปไตย ได้ออกไปร่วมทำกิจกรรมต่อต้านรัฐประหารที่ร้านแม็คโดนัลด์ สาขาเซ็นทรัลพลาซ่า จ.เชียงราย โดย ช.1 ได้ร่วมรับประทานไก่ทอดและเบอร์เกอร์แม็คโดนัลด์ และร่วมชูป้ายที่มีข้อความ “No Coup” นอกจากนั้นยังใส่หน้ากากที่ปิดทับด้วยเทปสีดำเป็นรูปกากบาทอีกด้วย
พฤติการณ์การจับกุม: วันที่ 25 พฤษภาคม 2557 ภายหลัง ช.1 เริ่มดำเนินกิจกรรมกับประชาชนคนอื่นๆ ที่มาร่วมแสดงออกในการต่อต้านรัฐประหาร ได้มีทหารซึ่งปลอมตัวเป็นพนักงานประจำร้านแม็คโดนัลด์ ชี้เป้าให้ทหารนอกเครื่องแบบคนอื่นๆ เข้ามาจับกุมภรรยาของ ช.1 เขาจึงพยายามเข้าไปช่วยกันภรรยาออกมา ด้วยการต่อยที่หน้าของนายทหารคนหนึ่ง (จากนั้น ทหาร จึงเข้ามาต่อยเขาคืน) จึงทำให้ ช.1 ถูกทหารนำตัวมาสอบสวนและควบคุม
ข้อหา: ฝ่าฝืนประกาศ คสช. ฉบับที่ 7/2557 ห้ามชุมนุมทางการเมือง
ความเคลื่อนไหว:
25 พฤษภาคม 2557 ถูกควบคุมตัวที่ค่ายเม็งรายมหาราช 7 วัน
1 มิถุนายน 2557 ถูกคุมตัวไปที่สถานีตำรวจภูธรเมืองเชียงรายเป็นเวลาหนึ่งวันกว่าๆ แต่เนื่องจากพนักงานสอบสวนยังทำสำนวนไม่เสร็จ จึงถูกนำตัวไปขออำนาจศาลในการฝากขังผลัดแรกเป็นเวลา 12 วัน
2 มิถุนายน 2557 ถูกคุมตัวไปที่ศาลจังหวัดทหารเชียงราย เพื่อฝากขัง หลังศาลมีคำสั่งฝากขังจึงถูกนำตัวไปไว้ที่เรือนจำ จ.เชียงราย ราวครึ่งวัน ต่อมาทนายความยื่นขอประกันตัว และศาลอนุญาให้ประกันด้วยด้วยหลักทรัพย์ 20,000 บาท

Accused: Chiang Rai man 1
Background of accused: He is one of members of Mae Lao Group Loves Democracy in Chiang Rai province. He has participated in several political activities such as a candle-lighting session held at Mengrai five-way intersection in Chiang Rai province on 10 January 2014, and a joint communique with Mae Lao Group Loves Democracy which opposed to the PDRC (People’s Democratic Reform Committee) and Mr. Suthep Thaugsuban.
Alleged offence: On 25 May 2014, around 6.00 p.m, he and his wife who was a leader of Mae Lao Group Loves Democracy gathered and held the anti-coup activity at McDonald’s Central Plaza branch in Chiang Rai province. In addition to the group’s fried chicken and burgers eating session, he raised a sign “No Coup” and worn a mask with “X” sign made from a black tape.
Circumstance of Arrest: On 25 May 2014, while he and other dissidents were implementing the activity to against the military junta, there was a military official (named Jodi) who disguised himself as a McDonald’s employee and blended in the event in order to indicate the target that was his wife to other plainclothes military officials to arrest her. By trying to help his wife from being seized, he punched one military official in the face (after that, the military punched him back in return). Thus, he was caught and taken for an inquiry.
Charge filed: Violating NPCO Order No.7/2014
Progress of case:
25 May 2014 - He participated in the activity then he was arrested and detained at Mengrai Maharaj military camp for 7 days.
1 June 2014 - He was moved to Chiang Rai Police Station and detained for one night but an investigation officer hasn’t finished the case’s report yet; therefore, he would be taken to the court for requesting the first phase of detention for 12 days.
2 June 2014 - He was taken to Chiang Rai Military Court for the detention request. After the court granted its detention order, he was confined at Chiang Rai Remand Prison. However, his lawyer posted the bail in the same day and the court permitted to release him on bail in the sum of 20,000 Baht.
10 June 2014 - He signed and reported to the Chiang Rai Military Court.
13 June 2014 - Appointment to report to the Chiang Rai Military Court.
