ผู้ต้องหา : ชายชาวเชียงราย 2
ภูมิหลังผู้ต้องหา : เป็นพ่อของสุรีรัตน์ หรือ เจี๊ยบ แม่ลาว แกนนำกลุ่มแม่ลาวรักประชาธิปไตย จากคำบอกเล่าไม่เคยทำกิจกรรมแสดงออกทางการเมืองใดๆ มาก่อน
การกระทำที่ถูกกล่าวหา : วันที่ 25 พฤษภาคม 2557 เวลาประมาณ 18.00 น. ประชาชนกลุ่มหนึ่งได้ออกไปร่วมทำกิจกรรมต่อต้านรัฐประหารที่ร้านแม็คโดนัลด์ สาขาเซ็นทรัลพลาซ่า จ.เชียงราย เช่นการร่วมกันทานไก่ทอดและเบอร์เกอร์ แม็คโดนัลด์ ชูป้ายที่มีข้อความต่อต้านรัฐประหาร ในวันนั้น เสงี่ยมได้ตามลูกสาว (เจี๊ยบ แม่ลาว) ไปร่วมทานอาหารที่ร้านแม็คโดนัลด์ด้วย แต่ไม่ได้ชูป้ายข้อความใดๆ
พฤติการณ์การจับกุม : ขณะที่ทหารนอกเครื่องแบบกลุ่มหนึ่งพยายามจะจับตัวเจี๊ยบ แม่ลาว ซึ่งเป็นลูกสาวของเสงี่ยมไปควบคุมตัว เขาได้ออกมากอดลูกสาวไว้ และกันไม่ให้ทหารพาตัวเธอไป จึงได้โดนรวบตัวมาควบคุมตัวที่ค่ายเม็งรายมหาราชด้วย
ข้อหา : ฝืนประกาศ คสช. ฉบับที่ 7/2557 เรื่องห้ามชุมนุมทางการเมือง
ความเคลื่อนไหว :
25 พฤษภาคม 2557 – ไปร่วมกิจกรรม ถูกจับกุมและถูกควบคุมตัวที่ค่ายเม็งรายมหาราช 7 วัน
1 มิถุนายน 2557 – ถูกคุมตัวไปที่สถานีตำรวจภูธรเมืองเชียงรายเป็นเวลาหนึ่งวันกว่าๆ แต่เนื่องจากพนักงานสอบสวนยังทำสำนวนไม่เสร็จ จึงถูกนำตัวไปขออำนาจศาลในการฝากขังผลัดแรกเป็นเวลา 12 วัน
2 มิถุนายน 2557 – ถูกคุมตัวไปที่ศาลจังหวัดทหารเชียงราย เพื่อฝากขัง หลังศาลมีคำสั่งฝากขังจึงถูกนำตัวไปไว้ที่เรือนจำ จ.เชียงราย ราวครึ่งวัน ต่อมาทนายความยื่นขอประกันตัว และศาลอนุญาตให้ประกันด้วยด้วยหลักทรัพย์ 20,000 บาท
10 มิถุนายน 2557 – ไปเซ็นชื่อรายงานตัวที่ศาลจังหวัดทหารบก เชียงราย
13 มิถุนายน 2557 – นัดรายงานตัวผลัดแรก ที่ศาลทหารจังหวัดทหารบก เชียงราย
Accused : Chiang Rai man 2
Background of accused : He is the father of Sureerat or Jeab Mae Lao who is a leader of Mae Lao Group Loves Democracy. According to his claim, he has never participated in any political activities or either expressed opinion towards politics before.
Alleged offence : On 25 May 2014, around 6.00 p.m, a group of people gathered at McDonald’s Chiang Rai Central Plaza branch to eat fried chicken and burgers as well as showed anti-coup signs in order to protest against the military junta. On that day, he has accompanied to his daughter (Jeab Mae Lao) to have a meal at McDonald’s but he did not hold on any sign.
Circumstance of Arrest : While a group of plainclothes military officials was trying to arrest his daughter, Jeab Mae Lao, he enfolded his daughter in his arms to prevent her from being taken by the military officials. He consequently was brought to Mengrai Maharaj military camp for a detention.
Charge filed : Violating NPCO Order No.7/2014
Progress of case :
25 May 2014 - He participated in the activity then he was arrested and detained at Mengrai Maharaj military camp for 7 days.
1 June 2014 – He was moved to Chiang Rai Police Station and detained for one night and as an investigation officer hasn’t finished the case’s report yet; therefore, he would be taken to the court to requesting the first phase of detention for 12 days.
2 June 2014 - He was taken to Chiang Rai Military Court for the detention request. After the court granted its detention order, he was confined at Chiang Rai Remand Prison. However, his lawyer posted the bail in the same day and the court permitted to release him on bail in the sum of 20,000 Baht.
10 June 2014 - He signed and reported to the Chiang Rai Military Court.
13 June 2014 - Appointment to report to the Chiang Rai Military Court.
